1. Who is responsible for your data
[pending] (“Oye Vallarta”), with its address at [pending], is responsible for processing your personal data in accordance with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties and its applicable regulations.
Contact for any privacy matter: [pending].
2. What data we collect
If you only visit the site: we don't ask you to sign up. Your saved places and your trip (“My places” / “My trip”) are stored only on your own device, not on our servers. If you give us permission, we use your location only on your device to sort places by distance; we don't store it.
If you write to us or take part:
- Recommendations or contact form: name, phone and/or email, and your message.
- Business reviews: name (published) and email (not published; used to confirm the review is yours).
- Comments on news: name and comment (published).
- Site rating: rating and optional comment.
- Phone alerts: if you turn them on, your browser gives us a technical subscription ID; it doesn't include your name or your number.
If you list a business or have a “My business” account:
- Your name, email, phone (optional) and password (stored encrypted).
- Your business details: name, description, address, logo, photos and, if you provide them, WhatsApp, phone, website, social media and hours. These business details are published according to your plan.
- If you request the Premium plan: payment method, your message and, if you send it, the image of your payment receipt (only our team sees it).
Usage data: we count visits to sections and listings, and clicks on contact buttons, in aggregate and without identifying you, to show statistics to businesses. Our server logs technical data such as your IP address for security and abuse prevention.
We don't collect sensitive personal data.
3. What we use your data for
Necessary purposes:
- Replying to your messages and recommendation requests.
- Reviewing, publishing and managing business listings and “My business” accounts.
- Verifying and moderating reviews and comments.
- Handling Premium plan requests and payments.
- Keeping the site secure and preventing fraud and spam.
Additional purposes (you can opt out without affecting the above):
- Sending you alerts about events, deals and news from Puerto Vallarta, if you turned them on.
- Contacting business owners to offer them the Premium plan or remind them when it expires.
To opt out of the additional purposes, turn off alerts from the site menu or write to our privacy email.
4. Who we share your data with
We don't sell or rent your data. It is only shared with providers that help us run the site and process it on our behalf: the site's hosting service, the email delivery service and the browsers' notification services (for example Google, Apple or Mozilla, only if you turn on alerts). We may also share it when a competent authority requires it by law.
The business details published on the site are public by nature and can be seen and indexed by search engines such as Google.
5. Your ARCO rights and how to exercise them
You have the right to Access your data, Rectify it, Cancel it or Object to its use, as well as to withdraw your consent or limit its use.
Send your request to [pending] with: your name, a way to reply to you, a copy of your ID (or your legal representative's), a clear description of the data and the right you want to exercise and, if applicable, any supporting documents.
We will reply within 20 business days at most and, if your request is valid, carry it out within the following 15 business days.
If you have a “My business” account, you can correct your listing details directly from your dashboard.
6. Cookies and storage on your device
We use essential technical cookies to keep your session and protect forms. The site also stores in your own browser your saved places, your trip, the last area you picked and the weather info so it loads faster; you can delete them anytime from your browser settings. If you install the site as an app, we keep a copy of the pages you visit so they work offline. We don't use advertising or third-party tracking cookies.
7. How long we keep your data
Only as long as needed for the purposes described and to meet legal obligations. You can ask us to delete your account and your data at any time through our privacy email.
8. Changes to this notice
If we change this notice, we'll publish the new version on this same page with its update date.
9. Authority
If you believe your right to data protection has been violated, you can turn to the competent personal data protection authority in Mexico.
